Visional Pop, Inc. (“we”, “our”, or “us”) values the protection of your personal information and has adopted this Privacy Policy (this “Policy”) to explain how we handle such data and to inform you of your rights regarding your personal information.

“Share” means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating a consumer’s personal information by the business to a third party for cross-context behavioral advertising.

    ・The specific pieces of Personal Information we collected about you.
  • (2) Right to Request Deletion You have the right to request that we delete any of your Personal Information that we have collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable request, we will delete (and notify our service providers and contractors to delete the same) your Personal Information from our records, unless an exception applies.
    We may deny your deletion request if retaining the information is necessary for us or our service providers and contractors in order to:
    ・Complete the transaction for which the Personal Information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide goods or services requested by you, or reasonably anticipated to be requested by you within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
    ・Help to ensure security and integrity to the extent the use of your Personal Information is reasonably necessary and proportionate for those purposes;
    ・Debug products to identify and repair errors that impair existing intended functionality;
    ・Exercise free speech, ensure the rights of other consumers to exercise their free speech rights, or exercise other rights provided for by law;
    ・Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);
    ・Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent;
    ・Enable solely internal uses that are reasonably aligned with consumer expectations based on the relationship between you and us; or
    ・Comply with legal obligations.
  • (3) Right to Request Correction You have the right to request that we correct any of your inaccurate Personal Information that we have collected from you and retained. Once we receive and confirm your verifiable request, we will correct (and notify our service providers and contractors to correct the same), your inaccurate Personal Information. We may deny your request for correction if we determine that the contested Personal Information is more likely than not to be accurate based on the totality of the circumstances.
  • (4) Right to Opt Out of Sale or Sharing We have not sold or shared Personal Information collected from you in the last twelve (12) months and we will not sell or share the same in the future.
  • (5) Right to Limit the Use and Disclosure of Sensitive Personal Information We have not collected any Sensitive Personal Information from you in the last twelve (12) months and we will not collect the same in the future.
  • (6) Non-Discrimination We will not discriminate against California residents for exercising any of their rights under the CCPA. Moreover, unless permitted by the CCPA, we will not:
    ・Deny you goods or services;
    ・Charge you different prices or rates for goods or services, including by granting discounts or imposing penalties;
    ・Provide you with a different level or quality of goods or services;
    ・Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services; or
    ・Retaliate against our employees, applicants for employment, or independent contractors.
  • (7) Exercising Your Rights for a Disclosure Request, Deletion Request or Correction Request, etc. To exercise your rights for a disclosure request, deletion request or correction request, etc. described above, please submit a verifiable request to us by contacting us by using the contact channels set forth in “7. To Contact Us” below.

    Only you, a natural person or a person registered with the California Secretary of State that you authorize to act on your behalf, or a person who has a power of attorney or is acting as a conservator for you, may make a verifiable request related to your Personal Information. You may also make a verifiable request on behalf of your minor child.

    The verifiable request must:
    ・Provide sufficient information that allows us to reasonably verify you are the person about whom we collected the Personal Information or his/her authorized representative; and
    ・Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond thereto.

6. Retention Period

We will retain your Personal Information only for the period necessary to accomplish those purposes for which it was collected. In determining the proper retention period, we take into account factors such as the volume, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure, the objectives for which the Personal Information is processed and whether those objectives can be met by other means, as well as applicable legal obligations.

International Privacy Policy

Visional Pop, Inc. collects, uses, and discloses personal information (the “Personal Information”) both inside and outside of California, the United States. In order to protect Personal Information of data subjects outside of California, we have established this International Privacy Policy (this “International Privacy Policy”). This International Privacy Policy applies to any and all of our processing of Personal Information obtained from data subjects located outside of California.

In the processing of the Personal Information, we will comply with this International Privacy Policy, and the laws and regulations applicable to our processing of the Personal Information (the “Applicable Laws”).

1. Processing of Personal Information

  • (1) Acquisition of Personal Information We acquire Personal Information by legal and ethical methods, and at the same time, devote our utmost attention to ensuring that the Personal Information is used only for those purposes that are clearly specified in advance. When we ask you to provide your Personal Information, we will notify you of the purposes of acquisition and the details of use of such Personal Information in advance. The processing of Personal Information will be conducted within the scope of our legitimate business purposes and only to the extent necessary to achieve those purposes set forth in “(2) Purposes of Processing” below.

As a result of the disclosure, the Personal Information may be transferred to locations outside of the locations in which you are located. The Personal Information protection laws in such locations where Personal Information may be transferred may not have the same standard of protection as that of your location. In such cases, we will thoroughly examine the eligibility of the party to which the Personal Information is provided or entrusted and confirm that appropriate security measures are taken in the processing of Personal Information from the perspective of security of Personal Information.
  • (4) Procedures for Disclosure or Correction, etc., of Personal Information If you wish to request disclosure, correction, addition, deletion, suspension of use, suspension of provision to a third party, or data portability, etc., of the Personal Information, (or make an objection), as permitted under the Applicable Laws, please contact us by using the contact channels set forth in “4. The Company will usually respond to such request regarding Personal Information within a reasonable period of time, once when we can confirm that the request is made by the data subjects of the Personal Information and the data subjects are eligible to exercise the right under the Applicable Laws.
